India Leads in Internet Shutdowns, but Lacks Tool to Assess Impact, The Hindu Editorial Analysis
द हिंदू संपादकीय विश्लेषण: यूपीएससी एवं अन्य राज्य पीएससी परीक्षाओं के लिए प्रासंगिक विभिन्न अवधारणाओं को सरल बनाने के उद्देश्य से द हिंदू अखबारों के संपादकीय लेखों का संपादकीय विश्लेषण। संपादकीय विश्लेषण ज्ञान के आधार का विस्तार करने के साथ-साथ मुख्य परीक्षा हेतु बेहतर गुणवत्ता वाले उत्तरों को तैयार करने में सहायता करता है। आज का हिंदू संपादकीय विश्लेषण, विशेष रूप से किसी जवाबदेह तंत्र के अभाव में इन शटडाउन के प्रभावों का आकलन करने हेतु भारत में बढ़ते इंटरनेट शटडाउन पर चर्चा करता है ।
हाल ही में, पंजाब सरकार ने खालिस्तान समर्थक अमृतपाल सिंह को पकड़ने के लिए एक अभियान चलाते हुए चार दिनों के लिए मोबाइल इंटरनेट एवं एसएमएस सेवाओं को निलंबित कर दिया था। सरकार ने कहा कि यह कार्रवाई सार्वजनिक सुरक्षा सुनिश्चित करने, हिंसा को भड़काने से रोकने तथा शांति एवं व्यवस्था बनाए रखने के लिए की गई थी।
सॉफ्टवेयर फ्रीडम लॉ सेंटर (SFLC) भारत में इंटरनेट शटडाउन का रिकॉर्ड रखता है एवं पंजाब राज्य में ऐसे आठ मामलों की सूचना दी है।
यह ध्यान दिया जाना चाहिए कि भारतीय केंद्र सरकार राज्य सरकारों द्वारा लगाए गए इंटरनेट शटडाउन पर डेटा संकलित नहीं करती है।
भारत में इंटरनेट शटडाउन का मुद्दा अत्यंत महत्वपूर्ण है, एक गैर-लाभकारी संगठन एक्सेस नाउ के अनुसार, जो डिजिटल अधिकारों की रक्षा करता है, 2016 एवं 2022 के मध्य संपूर्ण विश्व में दर्ज सभी इंटरनेट शटडाउन का 60% भारत में हुआ।
विभिन्न रिपोर्टों ने इंटरनेट शटडाउन से जुड़ी लागतों का दस्तावेजीकरण किया है। उनमें से कुछ नीचे सूचीबद्ध हैं-
प्र. इंटरनेट शटडाउन क्या है?
उत्तर. एक इंटरनेट शटडाउन एक सरकार द्वारा लगाया गया निलंबन अथवा इंटरनेट एवं मोबाइल डेटा सेवाओं का सुविचारित व्यवधान है, जो प्रायः कथित सुरक्षा खतरों, सार्वजनिक सुरक्षा चिंताओं या गलत सूचना के प्रसार को नियंत्रित करने के लिए किया जाता है।
प्र. सरकारें इंटरनेट शटडाउन क्यों लगाती हैं?
उत्तर. सरकारें प्रायः अफवाहों, मनगढ़ंत समाचारों एवं हिंसक विरोधों के प्रसार को रोकने के साथ-साथ देश में विधि एवं व्यवस्था बनाए रखने के लिए इंटरनेट शटडाउन लगाती हैं।
प्र. भारत में कितने इंटरनेट शटडाउन हुए हैं?
उत्तर. सॉफ्टवेयर फ्रीडम लॉ सेंटर के अनुसार, 2012 के पश्चात से भारत में 400 से अधिक इंटरनेट शटडाउन हो चुके हैं।
प्र. भारत के किन क्षेत्रों में सर्वाधिक इंटरनेट शटडाउन हुआ है?
उत्तर. जम्मू एवं कश्मीर, उत्तर प्रदेश तथा राजस्थान में भारत में सर्वाधिक इंटरनेट शटडाउन हुए हैं।
प्र. इंटरनेट शटडाउन का व्यक्तियों एवं व्यवसायों पर क्या प्रभाव पड़ता है?
उत्तर. इंटरनेट शटडाउन का व्यक्तियों एवं व्यवसायों पर महत्वपूर्ण प्रभाव पड़ सकता है, जिसमें दैनिक जीवन में व्यवधान, वित्तीय हानि, स्वास्थ्य सेवा, शिक्षा एवं अन्य आवश्यक सेवाओं तक सीमित पहुंच के साथ-साथ अभिव्यक्ति की स्वतंत्रता एवं डिजिटल अधिकारों का उल्लंघन भी शामिल है।
प्र. क्या भारत में इंटरनेट बंद करना वैध है?
उत्तर. टेलीग्राफ अधिनियम एवं सूचना प्रौद्योगिकी (इनफॉरमेशन टेक्नोलॉजी/आईटी) अधिनियम के तहत भारत में इंटरनेट शटडाउन कानूनी है। हालांकि, भारत के सर्वोच्च न्यायालय ने निर्णय दिया है कि इंटरनेट एवं मोबाइल डेटा सेवाओं पर किसी भी प्रतिबंध को आनुपातिकता के सिद्धांत का पालन करना चाहिए एवं यह अनिश्चित नहीं हो सकता।
