The policy of law is to prevent storage of wealth for an unreasonable period by devices calculated to thwart the flow of properties through the normal channels of transfer and succession. This policy developed the rule against perpetuities which regulates the period for which the vesting of the property may be suspended. The same party requires that the accumulation of income would not be permitted beyond the period for which vesting may be deferred. Any direction for accumulation transgressing the rule against perpetuities is thus void and cannot be given effect to at all. The rule against accumulation is designed to curtail the perpetuity period and restrict the accumulation of income to narrower limits.
Section 17 of the Transfer of Property Act, provides that where the terms of a transfer of property direct that the income arising from the property shall be accumulated either wholly or in part during a period longer than:
A direction which separates the income from the ownership of property so as to postpone the beneficial enjoyment of property is a direction for accumulation. A direction for accumulation annexed to the grant of an absolute interest is void for repugnancy under section 11 of the Act. If such a direction transcends the perpetuity period, again it is void for remoteness. Section 17, however, recognizes three exceptions to the rule against accumulation:
कानून की नीति हस्तांतरण और उत्तराधिकार के सामान्य चैनलों के माध्यम से संपत्तियों के प्रवाह को विफल करने के लिए गणना किए गए उपकरणों द्वारा अनुचित अवधि के लिए धन के भंडारण को रोकने के लिए है। इस नीति ने शाश्वतता के खिलाफ नियम विकसित किया जो उस अवधि को नियंत्रित करता है जिसके लिए संपत्ति के निहित को निलंबित किया जा सकता है। उसी पार्टी की आवश्यकता है कि उस अवधि के बाद आय के संचय की अनुमति नहीं दी जाएगी जिसके लिए निहित को स्थगित किया जा सकता है। इस प्रकार शाश्वतता के विरुद्ध नियम का उल्लंघन करने वाले संचय के लिए कोई भी दिशा शून्य है और इसे बिल्कुल भी प्रभावी नहीं किया जा सकता है। संचय के खिलाफ नियम को स्थायी अवधि को कम करने और आय के संचय को सीमित सीमा तक सीमित करने के लिए डिज़ाइन किया गया है।
संपत्ति हस्तांतरण अधिनियम की धारा 17 में प्रावधान है कि जहां संपत्ति के हस्तांतरण की शर्तें निर्देशित करती हैं कि संपत्ति से उत्पन्न होने वाली आय या तो पूरी तरह से या आंशिक रूप से एक से अधिक अवधि के दौरान जमा की जाएगी:
एक दिशा जो संपत्ति के स्वामित्व से आय को अलग करती है ताकि संपत्ति के लाभकारी आनंद को स्थगित किया जा सके, संचय की एक दिशा है। पूर्ण ब्याज के अनुदान के साथ संलग्न संचय के लिए एक निर्देश अधिनियम की धारा 11 के तहत प्रतिकूलता के लिए शून्य है। यदि ऐसी दिशा शाश्वत काल से आगे निकल जाती है, तो यह फिर से दूरदर्शिता के लिए शून्य है। धारा 17, हालांकि, संचय के खिलाफ नियम के तीन अपवादों को मान्यता देता है:
